Gubernatorial Candidate Gilbert Wants To Assume Control Of Schools

If he becomes Nevada’s governor, Joey Gilbert would make an emergency state declaration to assume control of public schools in the state and tackle the growing instances of violence. A lawyer from Reno and erstwhile professional boxer, Gilbert cited a statute that concerns emergency management and that allows the governor to execute emergency powers for the following reason.

  • For the increasing and an existing chance of the incidence of an emergency or a disaster of never-seen-before size stemming from a natural cause or a man-made /technological catastrophe.

As per school officials and legal experts, Gilbert would find it difficult to implement his proposal. As for Gilbert, the proposal would let him take control of every school across the state and execute a plan to turn it around in weeks. Gilbert is among the many Republican candidates who look to face incumbent Governor Steve Sisolak this November.

Reno attorney Paul Anderson stated that laws are made legislatively and that the state governor could look to overturn long-time statutes. However, as for Anderson, overturning those statutes would be pretty extreme and would necessitate some form of legislative assistance. Anderson does not know whether the circumstance is so severe that it requires that degree of gubernatorial intervention.

Gilbert mentioned the rise in violence, substance misuse at schools, and academic rankings as the causes of an emergency declaration.

As per the law, a man-made catastrophe can be a crisis that involves violence on a public school bus, during a school event or at a school.

Sisolak also cited that same law while declaring an emergency state, which is ongoing, due to the epidemic two years ago.

The law requires Nevada to work together with the US federal administration as much as possible to implement emergency management functions. Gilbert discussed his plan the other week at a public school in Las Vegas, where a teenager is being accused of committing felonies, including attempted murder and sexual assault, as a grown-up person.

Gilbert stated that the provision entitles the state governor to use emergency powers as local control fails to resolve a man-made catastrophe or another catastrophe. As for Gilbert, it has failed to do for more than a decade. According to the poll, Gilbert is regarded as one of the five best contenders in the gubernatorial primary.

Early voting for the election will start on May 28, 2022, whereas June 14, 2022, is the polling day.

Declaring an emergency state would allow Gilbert to thoroughly and individually assess the individuals who lead Nevada’s schools. He also stated that he would determine the quality of those leaders and would replace the poor ones. To make that determination, Gilbert would check the track records of the leaders and what has been happing at their public schools.

Gilbert stated that he would remove leaders who have been bad at their job but would praise and elevate those who have been great at it. He added that the state would last only a hundred days as well as that he would bring an extraordinary legislative session about the state’s schools and would meet every appropriate party. Gilbert did not offer much information about what the declaration would involve. He only stated that he would release more information and that school students would keep pursuing in-person education in the takeover period.

Expecting teachers’ unions to resist the changes, Gilbert stated that there would be an option for those unions to support not just the teachers but also the changes. If the unions do not do it, Gilbert would decertify them.

As for Gilbert, no governor in the US has been made to use their emergency powers against the public-school education system of a whole state. At the same time, as for Gilbert, no state’s political and school leaders have shown little care for the future and education of their children before.

John Vellardita from the Clark County Education Association described Gilbert’s proposal as a case of usual, ring-wing sloganeering from a person aboard the Trump bandwagon to attract his voter base.

As for Vellardita, a state governor could make some form of intervention but could not do so for no reason. Vellardita stated that eliminating collective bargaining, under state statute, would require the Nevada State Legislature to approve the same.

CCSD trustee Katie Williams stated that the governor could assume control of schools but feels that the Legislature would need to approve it.

There are people other than Gilbert thinking about Nevada taking over schools too.

The Nevada State Board of Education(NSBE) has questioned the authority of the state to put the Clark County School District (CCSD) into the receivership situation for failing to implement AB-469 of the Legislature. For the uninitiated, AB-469 is a piece of reorganization legislation turning some central office responsibilities into local school responsibilities. For instance, it would autonomize principals to recruit the staffers who they think the best suit their school requirements.

In March 2022, a Nevada State Board of Education subcommittee talked about how a school takeover from the state would happen but is yet to take action.

The takeover happens when a US state takes over a school or district instead of the local education agency (LEA) and transfers it to its education agency.

The main cause of Nevada assuming control of the institution is school performance. As per a recent presentation made to that subcommittee, the takeover is possible in 33 states for financial or academic reasons.
